1. Scope of Services
Fairway Travel provides comprehensive travel planning and advisory services tailored to clients' needs. Our services include:
Providing customized travel planning, booking, and support services, including, but not limited to, accommodations, tours, transportation, and activities.
Offering personalized support for both individual and group travel logistics.
Services are subject to availability and are designed to meet the client’s preferences, budget, and travel objectives.
2. Client Responsibilities
Clients are responsible for:
Providing accurate and complete personal, travel, and payment information.
Ensuring that all travelers have valid travel documents, including passports, visas, and any required health certifications (e.g., vaccinations).
Reviewing all itineraries, confirmations, and documents provided by Fairway Travel for accuracy.
Fairway Travel is not liable for disruptions caused by missing or invalid travel documents or unreported inaccuracies in travel plans.
3. Service Fees and Payment
Fairway Travel charges service fees for its professional travel planning and advisory services. These fees cover the time, expertise, and resources invested in creating personalized travel plans.
Deposit: A deposit or full payment may be required at the time of booking, depending on the policies of the travel suppliers to secure services and confirm bookings. The deposit amount varies based on the total trip cost and supplier requirements. Payments made to Fairway Travel are non-refundable unless otherwise stated in the cancellation policy.
Consultation Fee: A non-refundable consultation fee is required before beginning travel planning services. This fee will be applied toward final booking costs if applicable. Fees will be disclosed during the consultation phase.
Final Payment: The remaining balance is due no later than 60 days prior to departure. For bookings made within 60 days, full payment is required at the time of booking.
Rush Fees: Expedited planning services requested within 7 days of departure may incur an additional fee.
Payment Methods: Payments can be made via bank transfer, credit card (fee applied), or check.
Exchange Rates: Fairway Travel is not responsible for fluctuations in exchange rates or fees imposed by financial institutions during payment processing.
4. Changes and Cancellations
Changes: Any client-initiated changes to bookings are subject to additional fees imposed by suppliers.
Cancellations: Cancellation policies vary by supplier. Fairway Travel will assist with cancellations and refund requests but cannot guarantee reimbursement.
Clients are strongly encouraged to purchase travel insurance to cover potential trip cancellations or interruptions.
5. Travel Insurance
Fairway Travel highly recommends purchasing comprehensive travel insurance for protection against:
Trip cancellations or interruptions.
Medical emergencies and evacuation.
Lost or delayed baggage.
If the client opts out of travel insurance, Fairway Travel is not liable for any financial losses or disruptions resulting from unforeseen events.
6. Liability Disclaimer
Fairway Travel acts as a consultant and intermediary between clients and travel suppliers. We are not responsible for any errors, delays, cancellations, or service failures on the part of third-party suppliers (e.g., airlines, hotels, tour operators, or event organizers).
Fairway Travel is not liable for injuries, damages, or losses incurred during travel, including those caused by force majeure events such as natural disasters, strikes, or pandemics.
7. Force Majeure
Fairway Travel is not liable for any failure to perform, delays, or disruptions in providing services due to circumstances beyond our control. These events include, but are not limited to:
Natural disasters (e.g., hurricanes, earthquakes, floods).
Acts of war, terrorism, or civil unrest.
Government-imposed restrictions, including but not limited to travel bans, lockdowns, or changes in visa or entry requirements.
Epidemics, pandemics, or other public health emergencies.
Labor strikes, airline disruptions, or other industrial actions.
Unforeseeable technical issues impacting transportation, accommodations, or event venues.
Impact on Services
In the event of a Force Majeure situation, Fairway Travel will make every effort to assist clients in rescheduling or altering their travel plans, subject to the terms and conditions of third-party suppliers.
Refunds, credits, or compensation for cancellations or disruptions due to Force Majeure events are subject to the policies of airlines, hotels, tour operators, and other travel providers. Fairway Travel cannot guarantee reimbursement for non-refundable deposits or payments.
Client Acknowledgement
By engaging Fairway Travel’s services, the client acknowledges that Force Majeure events are beyond the control of Fairway Travel and accepts the risks associated with such circumstances. Clients are strongly encouraged to purchase travel insurance to cover potential losses or disruptions caused by Force Majeure events.
8. Confidentiality
Fairway Travel respects client privacy. All personal information collected during the travel planning process is kept confidential and used solely to facilitate bookings and travel arrangements.
9. Governing Law
These terms and conditions are governed by the laws of the State of Georgia, USA. Any disputes arising from services provided by Fairway Travel will be resolved under Georgia law.
10. Agreement
By engaging Fairway Travel’s services, the client acknowledges and agrees to these Terms and Conditions, which form a legally binding agreement between the client and Fairway Travel. This agreement becomes effective upon the client’s acceptance of the services and payment of the applicable fees.
These Terms and Conditions constitute the entire agreement between the client and Fairway Travel, superseding any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
By confirming the travel arrangements and making payments, the client acknowledges that they have read, understood, and agreed to the terms and conditions set forth in this agreement.
